Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the rules and guidelines for using the CashTrack platform. Its purpose is to ensure the integrity, security, and reliability of the platform for all users. By using CashTrack, you agree to comply with this policy. Violation of this AUP may result in account suspension or termination.

2. Prohibited Content

You may not use CashTrack to create, store, or transmit:

  • Fraudulent invoices: Invoices for goods or services not rendered, inflated amounts, or fictitious transactions.
  • Money laundering records: Any records designed to disguise the origins, nature, or destination of illegally obtained funds.
  • Illegal goods or services: Invoices or records related to the sale of prohibited substances, counterfeit goods, or unlicensed services.
  • Harassing or threatening content: Invoice notes, descriptions, or communications that contain threats, harassment, or abusive language.

3. Prohibited Activities

You may not engage in the following activities:

  • Unauthorised access: Attempting to access accounts, data, or systems that you are not authorised to use.
  • API abuse: Using the CashTrack API in a manner that degrades performance for other users or exceeds documented rate limits.
  • Rate limit circumvention: Attempting to bypass or circumvent API rate limits through any technical means.
  • Data scraping: Automated extraction of data from the CashTrack platform without express written permission.
  • Impersonation: Creating accounts or invoices that impersonate another person or business entity.
  • Fake businesses: Registering accounts for non-existent businesses or using fabricated business information.

4. Financial Compliance Requirements

All financial activities on CashTrack must comply with the following:

  • Accurate invoicing: All invoices must reflect genuine transactions with accurate amounts. Inflating invoice amounts for the purpose of tax evasion or fraud is strictly prohibited.
  • Valid Tax Identification Number (TIN): Users accessing tax-related features must provide a valid TIN issued by the Federal Inland Revenue Service (FIRS).
  • Anti-money laundering compliance: Users must not use CashTrack to facilitate money laundering or terrorist financing activities.
  • No transaction structuring: Deliberately structuring transactions to avoid reporting thresholds or regulatory scrutiny is prohibited.

5. Bank Linking Requirements

  • You may only link bank accounts that you own or are legally authorised to access.
  • You must report any unauthorised access to your linked bank accounts immediately to CashTrack and your bank.
  • You are responsible for maintaining the security of your Mono bank connection credentials.
  • CashTrack reserves the right to disconnect bank accounts if suspicious activity is detected.

6. Invoice Sending Requirements

  • Invoices may only be sent to legitimate business contacts with whom you have a genuine business relationship.
  • All invoices must include valid sender information including your registered business name and contact details.
  • You must honour opt-out requests from recipients who no longer wish to receive invoices or reminders via email or WhatsApp.
  • Bulk invoice sending must comply with your subscription plan limits and applicable anti-spam regulations.

7. Nigerian Regulatory Compliance

Users must comply with all applicable Nigerian laws and regulations, including but not limited to:

  • Federal Inland Revenue Service (FIRS): Tax filing obligations, accurate tax reporting, and compliance with VAT and withholding tax requirements.
  • Companies and Allied Matters Act (CAMA): Business registration requirements and corporate governance obligations.
  • Nigeria Data Protection Commission (NDPC): Data protection and privacy obligations under the NDPA 2023.
  • Central Bank of Nigeria (CBN) Guidelines: Financial reporting standards and compliance with monetary policy directives.

8. International Compliance

Where users operate internationally or process data of individuals in other jurisdictions, they must also comply with applicable international regulations including the General Data Protection Regulation (GDPR) for EU/EEA data subjects and the California Consumer Privacy Act (CCPA) for California residents. CashTrack provides tools to assist with cross-border compliance, but ultimate responsibility rests with the account holder.

9. Account Limits & Fair Use

Each subscription plan includes defined limits for features such as the number of invoices, clients, team members, and API calls. Users must operate within the limits of their subscription plan. Automated bulk operations that exceed plan limits are not permitted. CashTrack reserves the right to throttle or restrict accounts that consistently exceed fair use thresholds.

10. Monitoring

CashTrack monitors platform usage to maintain security and compliance. Monitoring includes detection of:

  • Unusual transaction patterns: Anomalies that may indicate fraudulent activity or policy violations.
  • Excessive API calls: Usage patterns that exceed normal thresholds or suggest automated abuse.
  • Reported abuse: Complaints from other users or third parties regarding content or behaviour on the platform.

Monitoring is conducted in accordance with our Privacy Policy and applicable data protection laws.

11. Enforcement

Violations of this AUP will be addressed through a graduated enforcement process:

  1. Warning: Written notification of the violation with instructions to remedy the issue.
  2. Feature restriction: Temporary limitation of specific features related to the violation.
  3. Suspension: Temporary suspension of the entire account pending investigation or resolution.
  4. Termination: Permanent termination of the account for severe or repeated violations.

CashTrack reserves the right to skip steps in this process for severe violations that pose an immediate risk to the platform, other users, or regulatory compliance.

12. Reporting Abuse

If you become aware of any activity on CashTrack that violates this Acceptable Use Policy, please report it immediately to abuse@cashtrack.ng. Include as much detail as possible, including the nature of the violation and any relevant account or invoice information. All reports are investigated confidentially.

13. Appeals Process

If enforcement action is taken against your account, you may submit a written appeal within 14 days of receiving notification of the action. Appeals should be sent to legal@cashtrack.ng and must include a detailed explanation of why you believe the action was unwarranted. CashTrack will review the appeal and respond within 14 business days. During the appeals process, enforcement actions remain in effect unless otherwise stated.
